1. Custom Orders and Artwork
Nature of Goods: We specialize in handmade oil paintings. As every piece is hand-painted by an artist, slight variations in color, texture, and composition may occur compared to the original photo provided. These variations are a mark of authenticity and are not considered defects.

Photo Quality: The quality of the final portrait depends heavily on the quality of the photo you provide. We are not responsible for dissatisfaction arising from low-resolution or blurry reference photos provided by the customer.

Approval Process: We offer unlimited revisions during the creation process. We will share a digital preview of the painting for your approval before shipping. Once you approve the final preview and the item is shipped, the design is considered accepted.

2. Payment Terms
All orders must be paid in full at the time of purchase unless otherwise agreed in writing.

We accept payments through the methods available on our website at checkout.

Prices are subject to change without notice, but price changes will not affect orders that have already been confirmed.

3. Cancellations and Refunds
Our cancellation policy is specific to the custom nature of our business:

Before Shipping: You may cancel your order for a full refund at any time during the production process if you are not satisfied with the preview of the painting.

After Shipping: Once the painting has been shipped, sales are final. We do not accept returns or refunds for custom-made products unless the item arrives damaged.

4. Shipping and Delivery
Processing Time: Painting creation typically takes 10 days (including drying time). Shipping times vary based on destination.

Customs and Import Taxes: Buyers are responsible for any customs and import taxes that may apply. Giftzy.co is not responsible for delays due to customs processes at the destination country.

Address Accuracy: The buyer is responsible for providing a correct and complete shipping address. We are not responsible for orders lost due to incorrect addresses provided by the buyer.

5. Intellectual Property and Usage
Artist Rights: Giftzy.co retains the copyright to all artwork created. We reserve the right to display images of the commissioned paintings in our portfolio, website, and social media for promotional purposes.

Privacy Option: If you do not wish for your painting to be displayed publicly, you must inform us in writing at the time of order. We will respect your privacy and will not publish the image.

6. Limitation of Liability
In no event shall Giftzy.co, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
